These Terms of Service (the "Terms") and Privacy Policy and Refund Policy govern your use of all available Polly: AI NOTE TAKER services and applications (the "Application"), so please read them carefully before using Polly: AI NOTE TAKER.
In this document, we use Polly: AI NOTE TAKER to refer to all services and applications of Denali Digital Bilişim Limited Şirketi, including its AI-powered note-taking, summarization, and interactive chatbot features.
By using Polly: AI NOTE TAKER, you agree to be bound by these Terms. If you do not agree to these Terms, do not use Polly: AI NOTE TAKER. If you are using Polly: AI NOTE TAKER on behalf of an organization (such as your employer), you are agreeing to these Terms for that organization and are indicating that you have the authority to bind that organization to these Terms. In that case, "you" and "your" will refer to that organization.
We may revise the Terms from time to time. Changes may be posted within our Applications, so please check regularly.
Auto-Renewing Subscriptions
Subscription Services
Certain Polly: AI NOTE TAKER applications on the Apple App Store and Google Play Store will allow you to obtain the benefit of the application on a subscription basis. Payment for such a subscription (which may be daily, weekly, monthly, or yearly) may be processed in the application, by third parties who act on our behalf, or directly by the mobile platform owner (e.g., Apple or Google).
Free trial subscriptions may be canceled at any point up to 24 hours before the expiry of the free trial (Apple) or at any time before the end of the trial period (Google). You can cancel a subscription service at any time during the subscription period via the subscription settings in your iTunes or Google Play account. The cancellation will take effect after the last day in the relevant subscription period.
You can find further information on canceling orders and any associated refunds on the website of the third-party re-seller from whom you purchased the app (for example, the Apple App Store or the Google Play Store).
Trial Periods
Certain Polly: AI NOTE TAKER subscription services may from time to time be offered for a fixed period of time on a free-trial basis. You are free to cancel a free-trial subscription at any time via the subscription settings in your iTunes or Google account.
Your Information and Responsibilities
To use Polly: AI NOTE TAKER, you can optionally create an account, either via the Application or through your account with a third-party service such as Google or Apple. In the latter case, your Polly: AI NOTE TAKER account will be created using the information you provided to that service, such as your name, email address, and other personal information that your privacy settings on that service permit us to access.
You may use Polly: AI NOTE TAKER only if you are 13 years or older and are not barred from using Polly: AI NOTE TAKER under applicable law.
You are responsible for safeguarding the password that you use to access Polly: AI NOTE TAKER. You are responsible for any activity on your account, whether or not you authorized that activity. You should immediately notify Polly: AI NOTE TAKER of any unauthorized use of your account.
By using Polly: AI NOTE TAKER, you provide us with text, audio, images, and other content ("Your Content"). You retain full ownership of Your Content. Polly: AI NOTE TAKER does not claim any ownership rights over Your Content.
However, you are also solely responsible for Your Content. You indicate that you own or have the necessary rights to all of Your Content, and that use of Your Content does not infringe, misappropriate, or violate a third party's intellectual property rights, rights of publicity or privacy, or any applicable law or regulation.
Polly: AI NOTE TAKER Intellectual Property Rights
Except for Your Content, Polly: AI NOTE TAKER and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, and all Intellectual Property Rights related thereto, are the exclusive property of Denali Digital Bilişim Limited Şirketi and its licensors.
Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from any Polly: AI NOTE TAKER content.
Disclaimer of Warranties
Polly: AI NOTE TAKER is provided on an "as is" and "as available" basis. Use of Polly: AI NOTE TAKER is at your own risk. To the maximum extent permitted by applicable law, Polly: AI NOTE TAKER is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that:
Polly: AI NOTE TAKER will meet your specific requirements.
The Application will be available uninterrupted, secure, or error-free.
The quality, accuracy, or completeness of AI-generated summaries, transcriptions, or chatbot responses will always be perfect.
Users should understand that AI-generated content may contain errors and should not be relied upon as a substitute for professional or legal advice.
Indemnity
You agree to indemnify and hold harmless Denali Digital Bilişim Limited Şirketi and its officers, directors, employees, and agents from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with:
Your access to or use of Polly: AI NOTE TAKER.
Your content, including any AI-generated summaries, notes, or chatbot interactions.
Your violation of these Terms or any applicable law or regulation.
This indemnification obligation will survive termination of these Terms and your use of Polly: AI NOTE TAKER.
Limitation of Liability
NEITHER POLLY: AI NOTE TAKER NOR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING, OR DELIVERING POLLY: AI NOTE TAKER, INCLUDING OUR LICENSORS, WILL BE LIABLE FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO:
LOST PROFITS, LOSS OF DATA OR GOODWILL
SERVICE INTERRUPTION
COMPUTER DAMAGE OR SYSTEM FAILURE
COST OF SUBSTITUTE SERVICES
ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF OR INABILITY TO USE POLLY: AI NOTE TAKER OR OUR LICENSORS' INTELLECTUAL PROPERTY, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT POLLY: AI NOTE TAKER HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, EVEN IF A LIMITED REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
General Terms
These Terms constitute the entire and exclusive understanding and agreement between Denali Digital Bilişim Limited Şirketi and you regarding Polly: AI NOTE TAKER, and these Terms supersede and replace any and all prior oral or written understandings or agreements regarding the Application.
If for any reason a court of competent jurisdiction finds any provision of these Terms invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the other provisions of these Terms will remain in full force and effect.
You may not assign or transfer these Terms, by operation of law or otherwise, without Denali Digital Bilişim Limited Şirketi's prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and of no effect. Denali Digital Bilişim Limited Şirketi may freely assign or transfer these Terms without restriction.

For notices made by email, the date of receipt will be deemed the date on which such notice is transmitted.
Denali Digital Bilişim Limited Şirketi's failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. A waiver will only be effective if in writing and signed by a duly authorized representative of Denali Digital Bilişim Limited Şirketi.
Except as expressly set forth in these Terms, the exercise by either party of any of its remedies under these Terms will be without prejudice to its other remedies under these Terms or otherwise.
